Terms of Service

These Terms of Service (the “Terms”) govern your use of the LetsLose Weight Loss & Wellness website and online store (collectively, the “Site”). Throughout these Terms, “LetsLose,” “we,” “us,” and “our” refer to LetsLose Weight Loss & Wellness. By visiting the Site or purchasing a product, you agree to these Terms and to our Privacy Policy, Refund and Replacement Policy, and Shipping Policy.

1. Eligibility and acceptance

You must be at least the age of majority in your state of residence, or have permission from a parent or legal guardian, to use the Site or place an order. If you do not agree to these Terms, do not use the Site or purchase through it.

2. Retail products and availability

Our online store currently offers Lipo Tabs, Chroma Plus, and Clynze Pure. Product availability, descriptions, packaging, ingredients, pricing, and promotions may change without notice. We may limit quantities, discontinue products, correct errors, or cancel or refuse an order when reasonably necessary, including for suspected fraud, misuse, pricing errors, inventory issues, or legal or safety concerns. If we cancel an order after payment, we will refund the canceled amount.

3. Health and dietary supplement disclaimer

Products and information on the Site are provided for general wellness and informational purposes. They are not intended to diagnose, treat, cure, or prevent any disease and are not a substitute for individualized medical advice, diagnosis, or treatment. Statements regarding dietary supplements may not have been evaluated by the U.S. Food and Drug Administration.

Consult a qualified healthcare professional before using a supplement, especially if you are pregnant or nursing, under 18, have a medical condition or allergy, take medication, or are preparing for surgery. Read the complete label and use products only as directed. Stop use and seek appropriate medical attention if you experience an adverse reaction. Results vary, and no particular result is guaranteed.

4. Retail purchases are separate from healthcare services

Purchasing a product through the online store does not create a physician-patient, practitioner-client, or other clinical relationship with LetsLose or any affiliated professional. The retail store is not intended for emergencies or for submitting sensitive health information. For a medical emergency, call 911 or seek immediate medical care.

5. Orders, billing, and account information

You agree to provide current, complete, and accurate order, billing, shipping, and contact information. You authorize us and our payment providers to charge the payment method selected at checkout for the order total, including applicable shipping charges and taxes. You are responsible for safeguarding your account credentials and for activity conducted through your account.

6. Prices, taxes, promotions, and payment

Prices are shown in U.S. dollars unless otherwise stated. Applicable taxes and shipping charges are displayed at checkout. Promotions are subject to their stated terms, cannot be combined unless expressly allowed, and may be modified or ended as permitted by law. Payment processing is provided by Shopify and its payment partners; we do not directly store complete payment-card numbers.

7. Shipping, risk, and delivery

Orders are generally processed within three business days and currently ship by USPS Priority Mail. Delivery dates are estimates, not guarantees. Shipping is governed by our Shipping Policy. Title and risk of loss transfer as provided by applicable law. Nothing in these Terms limits rights that cannot legally be waived.

8. No general returns; damaged or incorrect orders

For health, safety, and product-integrity reasons, all product sales are final and we do not accept returns or exchanges. We will refund or replace an item that arrives damaged or is not the item ordered, subject to the eligibility and reporting requirements in our Refund and Replacement Policy, which is incorporated into these Terms.

9. Personal and permitted use

Products are sold for personal use unless we agree otherwise in writing. You may not use the Site or products for an unlawful purpose; resell products in violation of law or contract; interfere with Site security or operation; introduce malicious code; scrape or harvest information without authorization; impersonate another person; or infringe the rights of LetsLose or others.

10. Intellectual property

The Site and its content—including text, graphics, photographs, logos, trademarks, product names, videos, downloads, and design elements—are owned by or licensed to LetsLose and are protected by applicable intellectual-property laws. We grant you a limited, revocable, nonexclusive right to access the Site for personal, noncommercial use. No content may be copied, modified, distributed, sold, or exploited without prior written permission, except as allowed by law.

11. Reviews and other submissions

If you submit a review, comment, idea, photograph, or other non-confidential content, you represent that you have the right to submit it and that it is truthful, lawful, and does not infringe another person’s rights. You grant us a nonexclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, and display that content for operating and promoting our business, subject to our Privacy Policy. We may remove submissions that violate these Terms.

12. Third-party services and links

The Site may use or link to third-party services, including Shopify, payment providers, shipping carriers, analytics providers, and social-media platforms. Third parties operate under their own terms and privacy practices. To the extent permitted by law, we are not responsible for third-party sites, services, content, or acts outside our control.

13. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LETSLOSE AND ITS OWNERS, AFFILIATES, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM THE SITE OR A PRODUCT. OUR TOTAL LIABILITY FOR A CLAIM RELATING TO A PURCHASE WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM. These limitations do not apply where prohibited by law or to liability that cannot legally be limited.

15. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless LetsLose and its affiliates, personnel, and service providers from third-party claims, losses, liabilities, and reasonable expenses arising from your unlawful misuse of the Site, your violation of these Terms, or your infringement of another person’s rights.

16. Governing law and disputes

These Terms are governed by the laws of the State of Alabama, without regard to conflict-of-law principles. Any dispute not resolved informally will be brought in a court of competent jurisdiction located in Jefferson County, Alabama, unless applicable consumer law requires otherwise. Before filing a claim, please contact us and allow a reasonable opportunity to resolve the concern.

17. Changes and severability

We may update these Terms by posting a revised version and effective date. Changes apply prospectively unless otherwise stated. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. These Terms and the policies referenced in them constitute the agreement governing your use of the retail Site.
